End User License Agreement

The licence terms for using the Dark Skies app on iOS and Android. This EULA supplements our Terms of Use, which cover subscriptions, disclaimers, and liability in full.

1. Your licence

Subject to your compliance with this EULA, applicable law, and the rules of the store you downloaded it from, Dark Skies grants you a limited, personal, non-exclusive, non-transferable, revocable licence to download and use the Dark Skies app on devices you own or control, for your own night-photography and astrophotography planning. This licence is revocable if you materially breach this EULA or the Terms of Use.

2. Apple App Store — standard licence terms

If you obtained Dark Skies through Apple's App Store, your use is also covered by Apple's Licensed Application End User License Agreement ("Apple's Standard EULA"), which governs alongside this EULA. Where this EULA and Apple's Standard EULA both apply, the following acknowledgements apply and control over any conflicting provision in this EULA:

  • This EULA is concluded between you and Dark Skies only, not with Apple, and Dark Skies — not Apple — is solely responsible for the app and its content.
  • The licence granted is limited to a non-transferable licence to use the app on Apple-branded products you own or control, as permitted by Apple's Usage Rules.
  • Apple has no obligation to furnish any maintenance or support services for the app; Dark Skies is solely responsible for providing support, to the extent required by this EULA.
  • In the event of any failure of the app to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any) for that app; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Dark Skies, not Apple, is responsible for addressing any claims relating to the app or your possession or use of it, including product-liability claims, claims that the app fails to conform to legal or regulatory requirements, and consumer-protection claims.
  • In the event of a third-party claim that the app infringes intellectual property rights, Dark Skies, not Apple, is solely responsible for the investigation, defense, settlement, and discharge of that claim.
  • You represent that you are not located in a country subject to a U.S. government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
  • You must comply with applicable third-party agreements when using the app (for example, your wireless data-service agreement).
  • Dark Skies' contact information for end-user inquiries is [email protected].
  • Apple and Apple's subsidiaries are third-party beneficiaries of this EULA, and upon your acceptance, Apple has the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.

3. Google Play

If you obtained Dark Skies through Google Play, this EULA and our Terms of Use apply, alongside Google Play's own terms governing your purchase and use of apps through that store, including billing, subscriptions, and refunds.

4. What you agree to

  • Don't copy, redistribute, resell, rent, lease, or sublicense the app.
  • Don't reverse-engineer, decompile, or modify the app, except where applicable law expressly permits it.
  • Don't circumvent, disable, or interfere with subscription checks, feature gating, or other technical restrictions.
  • Don't scrape, extract, or redistribute the app's bundled datasets (including darkness/nighttime-light data or destination-catalog data) outside the app.
  • Use the app lawfully, and don't use it to trespass or access property or areas you don't have the right to enter.

5. Estimates, not guarantees

Dark Skies provides planning estimates, not guarantees. Weather, darkness, moon, Milky Way, and Night Score information — including any AI-generated explanatory text — may be incomplete, delayed, or inaccurate. Dark Skies does not verify whether a location is legally accessible, open, safe, or reachable. Don't rely on the app for safety-critical decisions, and always use your own judgement about weather, terrain, access, closures, permits, and personal safety.
